Hi Team,

Please give me clarification, employers can keep the leave encashment policy. employee minimum working tenure of 2 year in company is only eligible for balance encashment and which will be encashed at the time of full & final settlement.

Please confirm as per the law if possible this or not

Hi,

As per law, every employee is entitled to annual leave with wages at the rate of one day for every twenty days of work performed by an adult employee and one day for every fifteen days of work performed by a young person. Leave enhanced the carry forward limit to 45 days. The accumulated leave encashment will be based on the prevailing rates of wages as on the date of encashment. The employers have to make the required changes in their internal leave policy. If an employer is already providing a better leave accumulation policy, there is no restriction.

And Employer should Consider Earned Leave only for Encashment at the time Full and Final Settlement

Thanks for information my question is that whether in leave policy we can write leave encashment eligibility criteria - only the compilation of 1 year and 8 month,

As per law, there is no such rule for encashment of Earned Leave that an employee should have completed 1 Year 8 Months. Earned leave is to be encashed at the time of F & F settlement even if he/she has worked for 1 year.
