# Can an employer sue an employee for fraud after their resignation and full and final settlement?

Usually companies wont go behind **ex-employees** , again it depend on the extend of the discrepancy or fraud.

However an employer can if there was a **written agreement** in **Appointment Letter, NDA Agreement** between employee & employer. Without a **written agreement** court take it as a contract on will or honor. That can be terminated by either party on will. So if there is a contract the an employee can sue otherwise it remains invalid.
