# If an employee completed 4.6 (four years & six months) as on his last working date. Whether he is eligible for Gratuity?

If an employee completed 4.6 (four years & six months) as on his last working date. Whether he is eligible for Gratuity?

Hello, As per norms Gratuity is payable only after completion of 4 years and 8 months . But usually organizations mandate it to 5 years, anyone leaving organization before that is not eligible for the gratuity. And as it is as per Act you won’t be able to challenge the same

@vksaravanan1220 Gratuity is applicable to an employee who completes 5 years of continuous service with the organization. Criteria of Eligibility is 4 years and 240 days. These 240 days of 5th year of service. Hope this helps.
