Hi Nisha,

Though there is no direct mandate imposed on the Employer, there are certain indirect obligations that will eventually lead the Employer/Establishment to have certain insurance policies effectively in place.

What are those obligations?
An Employer/Establishment that has employees should have Employment Compensation policies and provisions in place. This is governed by the Employees’ Compensation Act (formerly known as Workmen Compensation Act) and the rules framed for it.
[The Workmen’s Compensation Act,1923 (greythr.com)](https://www.greythr.com/wiki/acts/workmens-compensation-act1923/)
[Employees Compensation Act 2017 has been amended (greythr.com)](https://blog.greythr.com/employees-compensation-act-has-been-amended)

The following schedules of this Act provide you more details -
SCHEDULE I.—LIST OF INJURIES DEEMED TO RESULT IN PERMANENT TOTAL
DISABLEMENT.
SCHEDULE II.—LIST OF PERSONS WHO, SUBJECT TO THE PROVISIONS OF SECTION 2
(1) (nn),’ ARE INCLUDED IN THE DEFINITION OF EMPLOYEES.
SCHEDULE III.—LIST OF OCCUPATIONAL DISEASES.
SCHEDULE IV.—FACTORS FOR WORKING OUT LUMP SUM EQUIVALENT OF
COMPENSATION AMOUNT IN CASE OF PERMANENT DISABLEMENT
AND DEATH.

In order to comply with the compensation obligation, it becomes essential for the employer to have insurance policies with appropriate risk coverages.
Anyone who owns motor vehicles should have an insurance policy compulsorily.

Employers/Establishment that utilizes motor vehicles for the purpose of their business, employees, etc. should have the appropriate motor vehicle accidental policies and this is governed by the MV Act.

Other than the aforesaid, Establishments to minimize their operational risks generally cover their risks through additional policies such as General Liability Policy, Criminal Liability Policy, Fires, and Perils Policy, Burglary Policy, Cyber Liability Policies, etc.

Hope the above information helps.

Regards,
Bhuvana Anand

Nisha, one more point - One who is covered under ESI cannot claim under Employee Compensation Act.
