# When are women employees eligible apply for maternity leaves in their company?

Hi,

Women employees have a confusion that from when they are eligible to apply for maternity leaves. When exactly are they eligible to take maternity leaves?

Please share the details.

Hi,

It is advised to opt for Maternity leave 8 weeks prior from the due date as per the Act but if employee doesn’t opt for this leave than you need to take seld declaration from the employee stating" In this period I will take complete responsibility of my pregnancy or if anything happens to me and company will not be responsible."

THis declaration is mandatory.
