Is it mandatory to attach the hard copy of the PAN card of Landlord? Only PAN number is not suffice? Whether PAN of landlord is mandatory if the total rent payment not exceed 1 lac?

Dear experts-

For HRA, If rent paid per month is more than 10k per month, then should we take proof of payment since as per income tax act, any cash payment more than 10k is not allowed?

  • The income tax legislation makes it obligatory for the employer to obtain following details/ evidences in respect of HRA exemption:
  • Rent paid to landlord
  • Name of the landlord
  • Address of the landlord
  • PAN of the landlord

Further, where the aggregate rent paid during the financial year exceeds INR 1 lac, the employer is required to furnish aforementioned details in Form 12BB.

It is not mandatory to furnish hard copy of PAN, but to prevent incorrect reporting of PAN, organisation practically makes it compulsory for employees to furnish hard copy of PAN.

Regarding Home loan:Can we claim under all the 3 sections i,e., Sec 80C - Home Loan Principal Amount, Sec 24, Interest on Home loan, and Sec 80 EE/80EEA. Or Is it we can claim only under 2 sections ie., Sec 80C & Sec 24 or Sec 80C & Sec 80EE/EEA

As per the legislation, following deductions are allowed:

  • Home loan principal - Section 80C;
  • Interest amount - can be claimed under Section 24 and Section 80EE/EEA as well.

However, for the same amount doubly deduction is not allowed. For example, if the interest paid is INR 250,000. Then interest can be claimed under Section 24 at INR 200,000 and under Section 80EEA at INR 50,000.

Such an exemption can be claimed provided the insurance premium has been paid by the tax payer himself.

Where the rent amount exceeds Rs 1 Lac the PAN number needs to be given, PAN card is not mandatory, However it would be nice to submit the copy of the PAN such that the HR / Payroll dept can see the owners name on PAN card and match the same with Rent Agreement Copy.

What happens if the employee is not willing to declare his/her previous employment income. Please guide.

In such a case, the current employer will not consider the previous employment income and calculate withholding taxes at a normal slab rate. The problem will come at the time of finalising the tax computation before filing the return of income, cause if both the employer have taken advantage of slab rates, then there could be a situation of additional taxes alongwith interest implications.
