Creche Facility Under MBA 2017 - Payment will be the liability of the firm or employee

I n case the number of female employees is less than 50, is this provision still mandatory.

Who will be providing for the cost incurred on the same

As per the Maternity Benefit (Amendment) Act, 2017, also known as the MBA 2017, it is the employer’s responsibility to provide a creche facility to female employees with 50 or more employees in an establishment. The Act mandates that every establishment with the specified number of female employees must have a creche facility located either within the premises of the establishment or at a convenient distance.

The payment for the creche facility is the liability of the employer, and they are responsible for funding and maintaining the facility. The employer cannot transfer this financial burden to the employees.

The creche facility must be equipped with amenities such as a suitable room, childcare staff, and age-appropriate toys and activities to ensure the well-being and care of the children while their mothers are at work. This provision aims to support working mothers by providing them with a safe and convenient environment to leave their children while they fulfill their work responsibilities.

Employers must ensure compliance with the MBA 2017 and provide the creche facility as per the specified guidelines to support their female employees’ work-life balance and overall well-being. Failure to provide the mandated creche facility can result in legal consequences for the employer.
