Gratuity is payable on termination if employee has rendered continuous service for not less than five years. An employee is said to be in Continuous Service for 5 years, if employee has been in uninterrupted service for a period of 4 years and (i) 190 days in an establishment which works 6 days a week (ii) 240 days in an establishment that works 5 days a week. So in your case, the employee must be eligible for gratuity.
