Gratuity for Rejoined Employee

Is gratuity applicable after retirement ( retired Employee) and rejoined Employee?

The service of an employee employed again on regular basis after his retirement and settlement of statutory gratuity is a distinct and yet another spell of service in the same establishment which would entitle to him statutory gratuity if he completes not less than five years of service.

Agree with @Umakanthan Sir.

If he rejoins is considered to be a new tenure and entitled to Gratuity once again.

Re-joining has to be taken as fresh period for calculations of Gratuity or any other benefits.
