Hi,

I am still struggling with the details on gratuity deductions from CTC.

  1. The employer can deduct the gratuity component from the monthly salary?
  2. What if someone resigns before completing 5 years of service? will he get that deducted gratuity amount?
  3. How can he claim for his gratuity deduction while leaving from an organization before 5 years of service.

Hi

FTC— Fixed term contract employee to have a legal set back it will be for 11 months and in the 12th month employee will be given service break… This is done to avoid the contract employee gaining 240 days in a year. Usually done in manufacturing sectors which is done by HR’s and also called as unfair practise by HR’s :rofl: :rofl:

If it is desk job employees, you can take them for a certain specific period(project based) and his employment terms and conditions stands null and void after that particular period. But, when you want to hire 2nd time for the same position, first employee has to be considered ethically and legally unless his performance is poor.

  1. No…Employers generally add gratuity (4.81%)as part of the CTC to make it look attractive, but neither it is paid nor shown as deduction. Sec 2 sub (5) of Payment of gratuity act 1972 says that nothing shall affect the right of an employee to receive better terms of gratuity under any award or agreement or contract with the employer.
  2. service of 4 years and 8 months makes an employee eligible for Bonus (Usually considered as 5 years of serivce in wrong notion)
  3. If the employee service is less than 5 years, he is not eligible forbonus. If an eligible employee has not received bonus, he/she can give notice in Form I, wait for reply for one month and file a claim in From N.
