Paternity leave under the Indian labour law

Hey Community,

I need your views regarding Paternity leave under the Indian labour law.
My company employee (Male) is requesting for paternity Leave.
I need suggestions, if it is a part of compliance and mandatorily given?

Hi Somyata,

There is no labour law for Paternity Leave in India yet. However, many companies have voluntarily extended Paternity Leave to their male employees. Presently it is the company’s discretion whether or not to extend this benefit or for that matter, the number of Paternity leaves, usage criteria etc…

For Private Organisation, Paternity Leave is not mandatory as per statue.

It is not mandatory yet to give paternity leave. It is up to the company management.

You may think of giving N number of days as a paternity leave, which may be taken at a stretch or within a month. You can also decide how many times in the employment period it could be given, for example once or twice.

Hi @SOMYATA

There isn’t any such law that mandates private sectors to provide the paternity leaves to its employees. Therefore, paternity leave is open to interpretation by individual companies, and can draft policies that fit their Org. culture.
