Employee has resigned and requests for an early relive from the company after serving 30 days of 60 days notice period and If we recover the pending days in Full & Final settlement.
Will employee be eligible for gratuity for the last 30 days also(recovered in F&F settlement) or only till the last actual working day?
Gratuity will be payable till the last working day so the last 30 days will not be considered.
It would be actual last working day for all calculations like PF or Gratuity.
Employee will be eligible for Gratuity only till the last actual working day
Only till the last working day since the employer will show his Date of Leaving as the Last working day. The fact that you have recovered the notice period pay is a separate issue.
