We are 20 members company and we are working in a complete remote set up and it will get continue like this for next few years. It is a small team with less females, we cannot share our responsibilities to the other person whenever we are on leave as everyone is busy on their own task. In such cases, How to implement Maternity Policy while in working from home? Should we need to go with as per the maternity act or can we change the policy according to the company situation? If it is possible please suggest some ideas. Thanks.

Hi, if the company is unable to pay maternity benefits. Is that advisable, if the company advises its women employee to resign the job for maternity period and join again after 3 or 6 months as an new employee? Will that be ok? This was unanswered. Can you help?

Whether an employee is working from home or not, all are eligible for maternity leave . You just have to check whether she has worked for 80 days in last 12 months. As the person is already working from home you can request her to work as far as her health and circumstances permits.An employee eligible for maternity leave cannot be asked to resign. This is a statutory position, there is no permissible way to sidestep it.
