1)Leaves during notice period it will be considered as Loss Of Pay days.
2)If its paid leave days, last working day will need to be extended for number of leave days taken.

The first statement is not legal as it is availing of legally entitled leaves by the employee.
The second statement is legal as a certain number of days’ service is required as Notice period service as per the appointment letter is issued.
