If employees takes leave, Is there a compensation required in terms of extended notice period days or deduction as part of final settlement?

@RamyaV As per my knowledge, Annual Leave/Earner Leave cannot be taken but case to case basis Sick Leave can be availed. If AL/EL leave taken then it would be as per leave policy, either notice period can be extended or it can be considered as LOP.

Yes an employee can take leave during notice period. He/She is eligible for Sick leave. In sick leave notice period will not be extended plus employee has to provide medical certificate for those leaves.
If an employee takes leaves apart from Sick leave then it may be adjusted from his/her yearly allotted leaves or may be Notice period will be extended by those many days may be LOP as per the company rule.

It is purely dependent on each Company’s policy (leave rules and notice period rules) and may differ from Company to Company. While taking leave during notice period will affect work, one cannot overlook genuine reasons to attend to personal exigencies. It is better to leave it to the judgement of the department head to grant leaves and it can be kept to the minimum. Also, in certain job functions involving sensitive information, employers themselves prefer to relieve the resigned employee early or encourage leaves during notice period.

Employees are eligible for earned leave as per law. Hence, even if they cannot avail it during notice period, they will get it encashed in their full and final settlement, correct?

Earned Leave are statutory entitlements for an employee. So adjusting the notice period is possible. But again this is depending the Organisational Policy.
Usually during the notice period employee leaves are not granted as well as not allowed to take leaves too, other than sick leave.
Yes… employees are eligible for taking earned leaves during notice period. Compensation has to be paid for extended notice period. Earned leaves may or may not be adjusted against the notice period. Depends on the management decision but not on the policy beacuse every organisation expects resigned employee to serve notice period to ensure proper handovers.

Leaves during Notice Period is as per the Employment Terms & Conditions and Leave Policy & Separation Policy. If you have explicitly mentioned, No Leaves during Notice Period than you can restrict employee from taking any leave.
Instead, you should always discuss with HOD & Employee when he apply for leave and update Employee that you will have to finish particular tasks & give complete Handover to XYZ by the end of notice period. We will approve your leave but if the tasks and handover is not completed, we will have to extend the Notice Period.
In such cases, what will have a positive impact is Proactive & Timely Communication.
We should not assume anything in such cases be upfront to avoid any face-off at the later period.
