How many years of records should be preserved by an Employer under the Indian Labour and Employment Laws?

The Labour and Employment Laws in India imposes ‘Records Retention’ as a part of Statutory Compliance.

Can somebody help me with what all the records to be maintain in factory as per all acts relates to factories.

Please guide.

Is there something applicable to Companies that are registered under Shop and Establishment Act?

If Yes, Please suggest what all documents have to be maintained and how many years we should maintain it.

Some of the records as mentioned by the State Govt.

5. Records management:

  • Use format ‘A’ ; for Establishment registration/Renewal/To report change of information.
  • Use format ‘P’ ; to fix the different day as the weekly holiday.
  • Use format ‘F’; to maintain leave records and Use format ‘H’ ;to give the copy to the employee.
  • Use format ‘T’; to maintain daily attendance of employee.
  • Use format ‘R’; to get permission to allow women to work after 8 pm.

Annual report ending with 31st December shall be submitted before 31st January of next year in the format ‘U’.

Hello everyone,

Can you please let me know when is the due date for Annual Return to be filed with Karnataka Shop & Establishment Act. Also let me know the fee to be paid if any.

Hi Sreeja,

The last date to file the combined Annual Return (Form U) under Karnataka Shops & Commercial Establishments Act is 31st January every year.

There is no fee payable for filing returns. Fee is to be paid while applying for a new licence under the Act or at the time of renewal.
