Employees Background consists of Employment verification of previous company whether service certificates issued are authentic or not to be confirmed and Service details to be confirmed since many people are submitting false documents.

Based on the organization’s requirement, the background checks comprises verification of:

  • Identity
  • Educational qualifications
  • Authenticity of certificates
  • Work experiences
  • Criminal records
  • Health, etc.

Though there is no codified law relating to this, considering the ‘right to personal life and liberty’ (Article 21 of Indian Constitution) and Supreme Court’s judgment on ‘right to privacy’, employers have to be mindful while dealing with the background verification data.

That apart, the Information Technology Act, 2000, impose liability upon illegal and unauthorized use of data stored on computer systems.

The Credit Information Companies (Regulation) Act, 2005, impose liability upon leakage or alteration of credit history data that are collected and maintained.
