I wanted to understand few things about POSH Act.

  1. Registration:
    Where the company is suppose to register under POSH Act

  2. Due date for filing returns for Maharashtra and Gujarat State

  3. Standard format for annual report

  4. Internal Committee Constitution :
    Can we hire same external committee member for different branches or offices located in different parts of the country.

1. Registration:
Where the company is suppose to register under POSH Act

The company has to file its annual report from its principal place of business (regd. office / corporate office) to the concerned district / nodal officer. If the organization has branches and registers any complaints from such branches, a copy of annual report to be filed before the corresponding branch’s nodal officer as well.

Timeline is on or before 31 January of FY.

As per Section 21 and 22 of the PoSH Act,

  1. Committee to submit annual report.— (1) The Internal Committee or the Local Committee, as the case may be, shall in each calendar year prepare, in such form and at such time as may be prescribed, an annual report and submit the same to the employer and the District Officer.
    (2) The District Officer shall forward a brief report on the annual reports received under sub-section (1) to the State Government.

  2. Employer to include information in annual report.—The employer shall include in its report the number of cases filed, if any, and their disposal under this Act in the annual report of his organization or where no such report is required to be prepared, intimate such number of cases, if any, to the District Officer.

4. Internal Committee Constitution :
Can we hire same external committee member for different branches or offices located in different parts of the country.

Yes, you can. Principally you have to constitute Internal committee as prescribed under the Act and Rules. If you are unable to meet the requirements, you may engage/appoint an external PoSH consultant who can guide you through the compliance end-to-end.
