Returning to Office, non-compliance to COVID-19 protocols at workplace?


Will non-compliance to COVID-19 protocols at workplace would be considered as misconduct ?

There are no guidelines to it. From the perspective of authorities, it is the organisation’s responsibility to ensure that SoPs laid down are followed.

It is highly sensitive and tricky too. There are a number of petitions filed across HCs and is pretty complex. So before getting in to the context of misconduct, the organization has to set the CAP - Covid Appropriate Behavior in workplace. Based on the nature of the organization, you may include this in Standing orders, Conduct, Discipline, and Appeal rules, Employment terms and conditions and so on.

Once this is done, then based on the issue and its nature, organization may initiate the disciplinary proceedings.
