Uttar Pradesh Covid Leave 28 days from Annual Leave?

Hello, we are a small setup of 11 employees currently registered in Noida, UP.
Query 1: 2 of our team members have been infected with Covid 19. I recently read somewhere that UP Govt. has announced a 28 days special paid leave for Covid employees. Can someone kindly explain the applicability of this notification? Does it mean that the employees annual leave balance will stay intact and this will be granted as a special leave?
Query 2: A 3rd team member is unable to work due to lockdown in Delhi. How will his leave be calculated?
Would appreciate urgent response.

To answer your question:

Employees working at shops, commercial establishments, and factories with 10 or more employees are covered in this order.

Uttar Pradesh government has announced 28-day paid leave for all coronavirus-infected employees and those who are under quarantine after coming in contact with another person & while coming back employees need present a -ve certificate.

This leave is apart from the regular leave balance that someone has, sometime the regular balance might be less than the 28, so considering this - this is an additional leave.

  1. Team member unable to work - in majority of cases it’s a LOP due to lockdown - but you can consider 1/2 salary for this or ask employee to use leave balances and for rest days pay 1/2 salary .

What are Karnataka and Kerala Government says on Covid leave? Do we have to give ? If so, how many days. Can employees use their existing leave?

The Karnataka Labour Department issued a circular on March 5,2020 stating all establishment within the state to grant 28 days of paid sick leave to the employee who has been infected by COVID-19. It specifies that any infected employee who works in an establishment covered by the ESI Act will have to produce a medical certificate issued by any ESI hospital to avail the 28 days of paid sick leave.

It’s for everyone. But the majority of employers keep it as 15 days of quarantine, as that’s what doctors prescribed, and these 28 days are majorly for Govt. Emp benefits which privates can dictate.

At present, there are no such circulars in recent days. But general guideline is 14 days for +ve employees.

Sir please clarify. In case an employee was down with all COVID symptoms, but did not get his medical test done and didn’t have any documents to submit to the office. What to treat his leave as? Please clarify.

For symptoms until a valid RT PCR done and getting confirmed it’s a normal sick leave or can avail CL etc as it’s not confirmed yet.

Later if confirmed we can move these leaves to COVID leaves and ask him to apply for the same

If you dont have proper documentation towards COVID positive and on the bases of COVID symptoms employee can avail leaves from their allotted leaves.

If he/she has proper COVID positive report /Doc’s prescription/ and other necessary docs then leave can be provided under COVID norms and notification.
