Hi @carefoundation

Posting the answer to your question on behalf of our ‘Legal Expert’.

The answer is No.

Firstly, the society (based on its nature) should fall within the permitted establishment within the ambit of ESI Act.

If society is eligible, it is applicable for its employees. A president and other office-bearers are defined separately from its employees.

Hope the above clarifies the question. If not you can continue this thread, our expert will soon be available here to take this up from Monday.

If Society Office Bearer Acting as an Employees and giving their time to the Organization then they will be eligible or not to enroll in ESI.

Hi,

An employee of a Society will be eligible if the Society is qualified as prescribed under the ESI Act for ESI Benefits.

However, as per Section 2 (xvii) of the Haryana Registration and Regulation of Societies Act ( 2012) an office-bearer means and includes the President, Vice-President, Secretary, Joint Secretary, Manager, Treasurer or any other member of the Governing Body empowered under the Bye-laws to give directions in regard to the conduct of the business of the Society.

The above Act is silent about defining the employees.

Considering the long-term debate on whether Labour Laws are applicable to the Societies, it will be appropriate to verify with the respective ESI office whether an Office-bearer can place himself in the capacity of an employee of the Society to register for ESI benefits.
