Employer responsibility for COVID deceased employee family

Hi Community,

In case of employees passes away due to COVID.

1. Employer is not liable to pay any compensation to close relatives. Correct?**

2. In what ways can a Employer/HR be of help to the employees close one with sorting out details of claims and compensation?

Any detailed steps or article would be very helpful.



  1. Correct.

  2. Ways would be:

  • Gratuity settlement including life cover

  • Leave Encashment

  • Accumulated bonus, if any

  • If covered under PF then EDLI benefit, PF accumulation withdrawal, Family Pension etc.

  • Mediclaim reimbursement

  • Suggesting about Personal level benefits like Pradhan Mantri Suraksha Bima Yojana(PMSBY), Atal
    Pension Yojana (APY), Life Insurance etc.

Along with this EDLI has also increased the max limit to 7 lakhs.


An employee passed away due to COVID-19, so we want to continue to pay the salary to his family. Can anyone let me know what is the way to handle this legally from the company side.
