Here’s how she can get maternity leave/benefits:
- Eligibility under the Maternity Benefit Act:
- The woman must have worked for at least 80 days in the 12 months immediately preceding the date of her expected delivery.
- The Act applies to establishments employing 10 or more people, including factories, mines, plantations, shops, and establishments.
- Maternity Leave:
- Eligible women are entitled to 26 weeks of paid maternity leave. For the first two children, 26 weeks of leave is provided; for the third child and beyond, 12 weeks of leave is granted.
- In case of miscarriage or medical termination of pregnancy, women are entitled to 6 weeks of leave.
- Maternity Benefits:
- The woman is entitled to receive maternity benefits in the form of her average daily wages for the period of her actual absence.
- Benefits also include a medical bonus if the employer does not provide pre-natal confinement and post-natal care free of charge.
- Application Process:
- The woman must inform her employer in writing about the expected date of delivery and apply for maternity leave. The employer is required by law to provide the necessary leave and benefits.
- Additional Provisions:
- After returning from maternity leave, women are entitled to additional breaks for nursing the child (nursing breaks).
- The Act also provides protection against dismissal during maternity leave.
If the woman works in an establishment covered by this Act, she can approach the HR department to ensure her rights are upheld and receive the appropriate benefits.
