Indian Statutory Law about Interns and their leave policies!

Hi All, What does Indian Statutory Law say about Interns and leave policy? As they are not employees, should they be allowed to take X number of days per month…what’s normal & allowed days ? we currently have interns with 6 months program…and its causing a lot of menace with leaves taken more than 10+ days each month.

If your organization is paying internship remuneration, you may deduct for the leave days. This is as good as probationary period. Hope they have had signed an Internship Agreement that mutually protects both the Employer and Interns’ interests.

They are still kiddos with a mindset of bunking classes, transition to Corporate environment is breaking their comfort zone :blush:

Hope you are not mixing up registers / systems purposed for employees with interns. Management is clear that interns are not employees but please make sure that there is clear demarcation when you use registers or systems as this helps to avoid confusion at the time of audits /inspections.

Regarding leave policy, it is good to have a separate one for interns. If the interns are not joined under any specific scheme of state/cwntral government, irrespctive of whether you pay stiphen or not, you can put specific rules to take care of the discipline at workplace. If the interns are deployed under some Government funded schemes, please get concurrence from the respective agency as well.

Yes, there is a legal employment letter signed by the Interns :slight_smile:

There is a leave register shared on a Monthly basis, includes FT, Contract & Interns in one sheet. Based on your input, I will advise the payroll to maintain this separately. And right now, the leave policy is applicable only for regular employees. If Intern leave need to be drafted separate, I will get that drafted quickly and sent for legal vetting…Thanks a lot.
