Can some one explain the maternity benefits availed for the third child

yes, she can be eligible for maternity leave if she has 2 other children have before joining the organization or any work.

I think the benefit is applicable only upto 2 surviving children and joining before or after is immaterial in this case. Please correct me if I am wrong.

Unable to find any rule to deny maternity benefit based on number of children. However a mother with two or more children will not be eligible for the increased maternity leave (26 weeks), and such women will be entitled to only 12 weeks of paid maternity leave of which not more than 6 weeks shall precede the date of her expected delivery.

For Maternity Leave, there is no boundation of number of child. There is boundation upto 2 children for Child Care Leave. Please find the attached PDF.

The amendment in 2017 clearly states the ‘number of children’ aspect.

Provided that the maximum period entitled to maternity benefit by a woman having two or more than two surviving children shall be twelve weeks of which not more than six weeks shall precede the date of her expected delivery;
