PF & ESIC Registration for New Firms

We wanted to register a new firm. Do we need to also register for PF& ESIC at the same time, even if we are not having minimum number of employees working.

Minimum 10 and 20 is the requirement after which mandatory registration to the ESIC and PF is required.

If it is Private Limited Company ESI & EPF registration comes alongwith Company registration. Otherwise ESI registration is required when the employee count is 9 and EPF registration is required when the employee count is 20. However voluntary registration option is available evenif employee count is less than the threshold limit.

PF & ESIC Code will automatically registered as soon as the company is incorporated, you only need to activate the code once the employee threshold is met.

First register the name of the entity under appropriate authority.
Apply for PAN (And TAN, if required).
Apply for GSTIN.
Pay Professional Tax for the entity.
If a mfg unit, register under Factories Act and apply for PCB consent.
If it is an office or an establishment, register under S&E Act
Then depending upon the criteria apply for PF & ESI
If the entity is a part of a group of entities, then better to register under PF & ESI even it doesn’t meet the criteria.

Hi @admin2022

Can I be clarified with the below please:
A company is registered in Karnataka, Mumbai and Chennai.

  1. Is it obligated to submit payment of PF tax to Mumbai and Chennai or it is fine he pays all in Karnataka?
  2. Is the PF submission centralized? meaning with the 3 registration and company only submits in Karnataka - will that be fine?

The head office is in Karnataka

Since EPF is a Central Act, one registration is sufficient. You can add all employees under one EPF registration and pay consolidated returns and pay it. No need to register separately for each state.

As you mentioned you are opening a firm and do not have minimum number of employees for ESI&EPF. so it is not mandatory for you to get ESI/EPF registrations unless you cross the minimum number employee under each Act. However, voluntary registration option is available.
