EPFO eligibility in case of demise of family member in road accident details

Good afternoon everyone,

Need your support on this, have two queries,

  1. My brother-in-law expired on road accident while returning back home from duty in Bangalore. He worked for 2 years in an organization & not married. He has only a dependent mother, is she eligible for a pension scheme under EPFO?

  2. Also he had a labor card, does her mother get benefits & process of claim?

Kindly suggest.

Thanks in advance.

Hey @Gowri ,

I’m sorry to hear about your brother-in-law’s passing away.

In regards to your question, if your brother-in-law was a member of the Employees’ Provident Fund (EPF) and had contributed to the scheme at least for a month, then his mother may be eligible for the monthly pension under the Employees’ Pension Scheme (EPS).

However, if your brother-in-law had not completed the required minimum one year of service, his mother may be eligible for a lump-sum amount under the Employees’ Deposit Linked Insurance (EDLI) Scheme.

The amount would be based on the average monthly wage drawn by your brother-in-law in the last 12 months preceding his death.

Regarding the labour card, it would depend on the specific benefits provided by the state or central government where your brother-in-law was employed.

Generally, labour cards are issued to workers in the unorganized sector to provide them with social security benefits such as health insurance, life insurance, and pension schemes.

To claim the benefits under the EPF, EPS, and EDLI schemes, your brother-in-law’s mother would need to fill out the necessary forms and submit them to the EPF office along with the required supporting documents.

The EPF office would then process the claim and disburse the benefits to the eligible beneficiaries.

It is recommended to consult with a legal professional or seek assistance from the EPF office for a detailed understanding of the process and eligibility criteria.

Hope that helps. Would like to know about another opinion too in case …
