If an employee is unemployed for 3 months and has withdrawn full PF amount. Then joined a new company later. Current basic salary in the new company is more than Rs.15,000/-

Can employee opt out of PF contribution ?

Hi community

If the employee employed previously and though withdrawn PF amount and in the current company if the Basic Salary is more than 15000 then Pension (EPS) only not applicable.

Since the employee is not member of PF at the time of joining the company they can opt out of PF also they qualify the basic more than Rs.15,000/-criteria

Experts correct me if wrong.
