Hi All Good Afternoon, I need a support for the Opt for PF,
If employees Basic Salary more then 15000 so can we remove from PF contribution with declaration form the employees( new and OLD both employees),

Hi,
For new employees, if basic is more than 15k then no need to contribute to pf unless he wants to contribute voluntarily.
For old employees, it is mandatory if he is already a member of pf. Even if his/her basic reaches above 15k you need contribute.

No you can’t opt out for PF since it is a Statutory issue.

Hi,
No, we cannot do that. PF Act says if an employee is already having any PF account he cannot opt out for this option. Instead he is newly joining and doesn’t have any PF account earlier then he can choose to opt out.

Yes you can proceed…with your opinion there was an option for the same , but the employee should have UAN i.e. means he should be contributing previously.

Hi,
An employee can be excluded from PF only if he is a new joinee into the PF scheme. If has already been enrolled into PF even once in any other company, then he cannot be excluded even though his salary is above 15K. An employee can be excluded only if he we are creating the UAN for the first time.
